Safe Work Environments
The law imposes several obligations on employers to provide a safe and healthy work environment for employees—and imposes serious sanctions where those obligations are not met. This session will review the various ways in which the law mandates a safe workplace, the consequences for failing to provide one, and tips for reducing risks to employers.
Nuts and Bolts: Advanced Mechanics of Terminations
While you may already have a grasp of the fundamental aspects of termination, this session will delve into the intricacies of the termination process. We will provide insights into advanced mechanics, offering tips and tricks for carrying out effective terminations. You will gain valuable knowledge on steering clear of additional damage awards resulting from improper conduct during terminations, selecting the right record of employment codes and understanding their effects, as well as unravelling the tax treatment of severance payouts. Additionally, we will highlight specific termination pitfalls that employers should be vigilant to avoid. Given the complexities of terminations, this session is designed to equip you with the essential information necessary to sidestep costly mistakes.
The Pain of It All: Dealing with WCB Claims
This session will delve into the recognition of the Federal Task Force on pain as an independent medical condition. It will comprehensively explore the rights and responsibilities associated with managing WCB claims, navigating the intricate WCB claims process, and addressing reviews with the Dispute Resolution & Decision Review Body, as well as appeals to the Appeals Commission. The session will also offer practical insights into employer rights and obligations. Furthermore, an in-depth examination of whether pain should be considered an independent medical condition in its own right will take place, accompanied by a discussion on the potential impacts that may arise from such a systemic change.
Employment Contracts – Beyond Basics and Boilerplate
Written employment contracts assist with managing employee relationships, minimizing potential liability, and setting employee expectations. A well-drafted employment contract provides certainty and predictability for both employer and employee alike.
In this session, we will go beyond the basics of employment contracts, and take a closer look at emerging issues in the interpretation of employment contracts, discuss how employment contracts can serve to minimize risk across a range of situations, and examine the proper steps to take when seeking to amend an existing employment contract.
Undue Hardship: What you need to know about Accommodation, Disability & Human Rights
In this session we will review and present on timely and practical matters related to an employer’s duty to accommodate. Focusing on both the employment law aspects and the human rights aspects related to accommodations, including managing employees on sick leave or Long Term Disability leave, this session will set out and discuss the best practices and potential pitfalls related to accommodation in the workplace. This practical session will be highly valuable for those involved in staffing considerations, particularly for those who act in a supervisory or leadership capacity.
