Words Matter – Unravelling Legal Language The law sometimes uses words in mysterious and unexpected ways. In this session, we’ll take a look at the interesting, surprising, and sometimes quirky ways that statutes, contracts, and courts use and abuse the English language. To quote a noted (though fictional) scholar: “You keep using that word – I do not think it means what you think it means.” |
Developments in the Law Related to Privacy Laws, Employer’s Search of Computers/Electronic Devices for Employee Misconduct, Breach of Privacy & Whistleblowing This session discusses recent developments in the law of privacy in the employment/labour context. A review of the law of privacy as it relates to employees and employers under what circumstances the computers and other electronic devices used for work/personal purposes may be accessed during misconduct investigations. The changes to Alberta’s public and private sector privacy and access to information legislation are reviewed. Whistleblowing and damages for breach of employee privacy are discussed. |
Supporting Mental Wellness in the Workplace: Accommodating and Addressing Challenges In this session, we will take a deeper dive into the topic of mental health in the workplace and how employers can best set themselves and their employees up for success in the long term. We will discuss the duty to accommodate in both the employment and human rights contexts, as well as managing employees on stress leave and long term disability leave. This session will also cover best practices for returning an employee back to work after a medical leave brought about by conditions like anxiety, depression, or PTSD. This practical session will be highly valuable for those involved in staffing considerations, particularly for those who act in a supervisory or leadership capacity. |
Managing Disability Leaves: Independent Medical Exams and Employer Considerations Employers are facing more complicated challenges relating to disability leaves for employees and the assessment of their validity. Independent medical examinations may be an option, but employers need to know what they are, what they can address, and how they can be used in complicated cases. |
Law & Order: Employment Edition – Hiring, Firing, and Everything in Between In this session, we will discuss the basics of employment law that every employer should know. From forming the employment relationship to navigating employee terminations, this session will focus on the key things to know at each stage of the employment relationship. We will discuss best practices and potential pitfalls related to hiring, managing and firing employees, including compliance with employment standards, human rights, and occupational health and safety legislation. |
Cleaning Up The Mess HR professionals are often called upon to clean up a mess created by a well-meaning manager who has proceeded with a termination without sufficient preparation. This session will examine the various things to consider in managing the fallout of less-than-ideal terminations, including paperwork, benefits conversion, records of employment, employee access to personnel files, stakeholder messaging, and more. |
