Demystifying the Litigation and Hearing Process: It’s Not Like What You See on TV
Learn what to expect when facing a lawsuit, grievance, or administrative complaint. In this session, our panel will walk through the key stages of court proceedings, labour arbitrations, and administrative hearings. We will cover timelines, questioning, settlement meetings, costs awards and risks, and litigation risks, along with the practical realities of participating in a court or administrative proceeding.
The Workplace Cast of Characters: Employment Relationships and Contract Best Practices
This session explores a variety of employment and contractual relationships, including full-time, part-time, seasonal, casual, and temporary arrangements. We will also examine when an employee is actually an employee, or when they fall into the categories of dependent or independent contractor. Attendees will gain practical guidance on structuring employment agreements to address different types of relationships and minimize risks if the employment relationship ends.
Where is Everybody? – Attendance Management Policies
This session provides an introduction to the legal requirements for enforceable and effective attendance management policies. We will also offer practical guidance on how to approach common attendance management issues that arise in both union and non-union work settings.  
Just Cause in Employment Relationships
This session examines how to establish just cause for dismissal in both the non-union and union sectors. Topics include the definition and onus of proving just cause, culminating and single incidents of misconduct, reinstatement considerations, near cause, after-discovered cause, employee loyalty and trust, condonation, off-duty conduct, bringing the reputation of the employer into disrepute, horseplay, falsification of credentials, investigations and mitigation. Attendees will gain practical guidance for navigating these complex workplace issues.
The Lifetime of a Leave: Addressing Medical Leaves in the Workplace
This session provides an introduction to the different types of medical leaves available to employees and an employer’s duty to accommodate employees returning from leave. Through practical case studies, we will examine common workplace scenarios and discuss tips and best practices for managing them. The session will also address how to respond to long-term medical leaves, particularly where the employment relationship is no longer sustainable.
